To apply and sponsor your partner to Canada, you must meet several requirements.
- You have to be a permanent resident, a citizen, or an Indian registered in Canada under the Canadian Indian Act.

- You became a permanent resident less than five years ago through the Partner Sponsorship Canada program.
- You have already applied to sponsor your partner to Canada and a decision on that application has not been made.
- You are still bound by the three-year undertaking to take care of the person you are being sponsored. In other words, you are still financially responsible for a previous spouse or partner.
- You receive social aid for a reason other than a disability.
- You are in prison or a penitentiary institution.
- You must leave Canada because you received a Removal Order.
- You have a criminal record of attempting, threatening to commit, or committing a violent criminal offense, an offense against a relative or any sexual offense inside or outside Canada.
- You did not meet all conditions of a sponsorship agreement when you applied to sponsor your partner to Canada program in the past. This requirement does not apply if you live in the province of Quebec.
- You did not pay back a performance bond, an immigration loan, court-ordered family support payments such as child support or alimony. However, this requirement does not apply if you live in the province of Quebec.
- You declared bankruptcy and are not discharged. This requirement does not apply if you live in the province of Quebec.
The partner also has to meet several requirements, that allow you to apply and sponsor your partner to Canada. Your partner of either sex must be 18 and more years old. You can sponsor your common-law partner to Canada as long as you have lived with them for at least one year in a marriage-like relationship. If you want to sponsor your conjugal partner (a person living outside Canada, who could not live with you because of reasons beyond their control) you must prove that you are in a conjugal relationship for at least 12 months. To sponsor your partner to Canada you must also prove that your relationship is genuine and there is a significant degree of attachment between the two of you. Your partner has to provide all required documents and forms with the sponsorship application, submit any additional information the immigration officer may request during application processing, such as biometrics and medical exams.
