Canada is an economically developed country that provides many opportunities for both blue-collar professionals and office workers. Foreign workers can gain not only valuable experience working with North American specialists and a stable income, but, subject to certain conditions, a permanent residence permit in Canada through the numerous federal and provincial immigration programs available. Every year thousands of people from all over the world receive work visas and come to Canada. By creating jobs for foreign workers, Canada is addressing labour shortages in industries critical to the country's economic development. A visa to Canada (temporary resident visa) is required for all citizens, regardless of the purpose of visiting Canada, whether it is tourism or visiting, study, work or business travel. Therefore, if you want to work in the biggest country of North America an entry visa is required for temporary residence in Canada. Obtaining the status of a temporary foreign worker is a complex process. In most cases, foreign workers need a work permit, which requires a job offer from a Canadian employer who, in turn, has received a positive Labor Market Impact Assessment (LMIA). However, there are exceptions. Some foreign nationals do not need a temporary work permit, while others only need a work permit without an LMIA. While working in Canada, foreign workers may be accompanied by their spouse, partner, dependent children. The Temporary Foreign Worker Program allows employers to attract foreign workers in the face of a shortage of Canadian blue-collar jobs. In this article, we will discuss how to get a temporary work permit in detail.

Nowadays, many people decide to move to Canada and work there because there are compelling benefits in their lives. To do this, first of all, workers from overseas must receive an approved job offer from a Canadian employer. A job offer can be permanent or temporary. It is important to obtain it before applying for a Work Visa Canada under the Temporary Foreign Worker Program. Work Visa Canada is a type of temporary visa. It is provided to foreigners by the Immigration, Refugees and Citizenship Canada (IRCC) program (TFW). The Temporary Foreign Worker Program allows employers in Canada to hire foreigners temporarily to compensate for labour shortages. Incidentally, it differs from the International Mobility Program, which creates jobs and helps develop the Canadian economy through the transfer of expertise. The length of stay in Canada with a temporary work permit can range from a few weeks to 2 years. In addition, workers must take into account the fact that a work permit does not permit them to enter Canada. Temporary Resident Visa (TRV) is issued by IRCC Canada and certifies that the holder meets the temporary visitor requirements. The visa can be single or multiple. Also, it will indicate the period during which you can enter Canada. Visa extensions can be requested from Canada.

It is important to be aware that getting a visa does not guarantee you will enter Canada. The final decision will be made by the immigration officer at the Canadian border, where you will have to confirm your purpose of travel and your intention to return to your country of residence. If an officer is in doubt about the true reason for your trip, you may be denied entry into Canada. If the person entering the country is a resident of a country with a visa-free regime, then to fly, he needs to obtain an eTA - electronic travel authorization. In addition, if a family member also wants to work in this country, he or she must also apply for the same documents as the main applicant (they can be submitted together). To be eligible for temporary work in Canada, you must meet the general requirements no matter where you apply. But the requirements may vary depending on where the application is made - from Canada, from outside Canada, or from Canada upon entry.

There are several steps to obtain a temporary work permit. Firstly, the process begins at the stage when an employer wishing to hire a temporary foreign worker must apply to Employment and Social Development Canada for a positive Labor Market Impact Assessment (LMIA). This document allows the employer to give preference in hiring a foreign worker, rather than a resident or citizen of Canada. After receiving a positive decision based on the results of considering an application for the LMIA, as well as having a job offer in hand, a foreign worker can apply for a work permit. A temporary work permit can also be issued by Immigration Canada without the need to first obtain a positive LMIA in such cases as if the applicant is employed under the international agreements (NAFTA or CUSMA), reciprocal employment, charitable or religious work, bringing socio-cultural benefits to the country or refugees. Also, study permit holders, spouses or permanent residence applicants do not need LMIA.

The second step follows right after a positive or neutral LMIA is received. The employer must provide a potential employee with the letter with an LMIA decision and prepare him or her a job offer. The company draws up a formal employment contract (Formal Employment Agreement) or job offer letter (Job Offer Letter) for the prospective foreign worker. For a successful temporary work permit, a job offer must be very detailed and it must include a title of the position in which the foreigner will work, a job description, including the main responsibilities and requirements for the position - the necessary professional education, skills, experience and licenses, detailed information about the dates of the beginning and end (if applicable) of work in the position, the specifics of remuneration - both salary and other forms of payment, the name and address of the employer, the address of the employee's future place of work, and information about the contact person of the Canadian employer company who can describe the job offer. Usually, a detailed job offer is prepared before a hiring company applies for LMIA.

The next step is when a foreign worker sends his or her application for a Temporary Work Permit in Canada and checks the necessity of a Temporary Resident Visa (TRV) or eTA. After processing the documents, Canada Border Services Agency (CBSA) issues the Temporary Work Permit. The requirements for experience, educational level and proficiency in English or French depending on the specific profession. If the applicant intends to work in the province of Quebec, they may also require a Certificate of Acceptance of Quebec for Temporary Work (CAQ) issued by the Quebec Immigration Service. To obtain a work permit, the applicant must convince the visa officer that he intends to comply with the conditions of temporary stay in the country and leave Canada at the end of the employment contract. When considering an application for a work permit, all previous travel and previously submitted applications will be taken into account. Much attention will be paid to the financial situation of the applicant to ensure that he does not seek financial assistance from the Government of Canada.

Another opportunity to get a temporary work permit in Canada is the Caregivers program that includes subcategories such as Home Child Care Provider Pilot and Live-in Caregiver Program (LCP). For Home Child Care Provider Pilot, an applicant does not need LMIA evaluation but there are special requirements that can be found on the website

Generally, temporary work permit applicants for the Caregivers stream are designed to provide home care for children, the elderly (over 65) and people with high medical needs (disabilities or chronic diseases). Minimum employment is 30 hours per week. These can include nannies, caregivers, nurses, and home care workers. Typically, work involves full employment - 40-44 hours per week. For employment, you need at least 1 year of work experience as a nanny or nurse, at least secondary education, knowledge of English or French at a level sufficient for everyday communication. You will also need a Labor Market Impact Assessment (LMIA), which is drawn up and paid by the employer, and a work permit. Meeting the requirements of one of the existing programs for caring for other people (childcare, caring for people with advanced medical needs) will lead you directly to obtaining a residence permit in Canada.

Another way to get an experience of temporary work in Canada is IEC. Foreign nationals from 34 countries aged 18 to 35 years again have the opportunity to work in Canada under the International Experience Canada (IEC) exchange program. Through IEC, candidates can come to Canada for the following work permit programs: Working Holiday, Young Professionals, International Co-op Internship. Using the Expression of Interest model, IEC issues invitations and sends them to the applicants to apply for a work permit. To do this, interested persons must fill out a form and get into the pool of applicants for a work permit. The type of candidate pool depends mainly on the country of citizenship and the categories of work permits available for that country, eligibility for the program is available here. The participants of IEC do not need LMIA.

The programs discussed in the article above do not provide permanent residence permits but can be a good starting point for immigration and permanent residence. After gaining one year of work experience in Canada, temporary work permit holders are eligible to apply for a residence permit under the Canadian Experience Class or Federal Skilled Worker Program. The applicant is eligible for a Bridging Open Work Permit, an interim work permit, on which he can continue to work while the IRCC decides on the application for a residence permit.
